1. Scope of the General Conditions of Sale
These general conditions of sale apply to all orders placed on the website www.waamcosmetics.com, and the buyer acknowledges having read them before confirming his order.
In case of modification, the general conditions of sale in force on the day of the order will be applied to each order.
2. Product availability
Our product offers and prices are visible on the site, while stocks last. The items offered are available for sale; items in the process of being replenished are indicated in the product description, and you are notified of this when placing your order.
3. Validation of orders and electronic signature (law of 13 March 2000 on electronic signatures)
A sale is concluded as soon as there is agreement on the goods and the price.
When the buyer validates an order, he automatically receives a confirmation email.
Any order for a product offered on the online store www.waamcosmetics.com implies consultation and express acceptance of these general conditions of sale, without however this acceptance being conditioned by a handwritten signature on the part of the buyer. In accordance with the provisions of articles 1316 to 1316-4 of the Civil Code, supplemented by Decree n ° 2001-272 of March 30, 2001, taken for the application of article 1316-4 of the Civil Code and relating to the electronic signature, It is recalled that the validation of the order form constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
The date of validation of the order corresponds to the date of the order in the event of payment by online bank card or the date of the cashing of the check in the event of payment by check.
The prices of our products are indicated in euros including tax, excluding shipping, packaging and order processing costs. They are calculated for sale to individuals.
WAAM Cosmetics reserves the right to modify its prices during the year but undertakes to apply the prices in force which will have been indicated to you at the time of your order, subject to availability on that date.
5. Terms of Payment (1)
By check in euros and issued on a French bank: Your order is then reserved for a period of 10 days. Beyond this period, without receipt of your check, it will be automatically canceled. The order will be processed upon receipt of your check. Make your check payable to DIECE SARL (see the sending address in chapter 14. Our contact details, at the bottom of this text).
By credit card Payment is made on the secure SYSTEMPAY platform in direct connection with our partner BANQUE POPULAIRE.
By Paypal If you have a PAYPAL account, you pay by logging in with your paypal username and password. PAYPAL is secure and you do not have to mention your credit card details.
By Bank Transfer The bank details and IBAN number are indicated to you on the payment validation page.
Your order is then reserved for a period of 10 days. Beyond this period, without receipt of your payment, it will be canceled. The order will only be processed upon receipt of your payment.
The buyer guarantees to WAAM COSMETICS that he has the necessary authorizations to use the payment method he has chosen for his order.
Any new order can only be made after regular payment by the buyer of the sums due in respect of his previous orders.
(1) For all orders exceeding the sum of 1000 euros including VAT, payment by bank transfer is required.
6. Retention of title clause
The products remain the property of WAAM COSMETICS until full payment of the order. It is expressly agreed between the parties that the transfer of ownership of the ordered goods becomes effective as soon as it leaves our warehouses. The buyer therefore accepts all risks, particularly those relating to transport.
7. Intellectual property
All texts, comments, works, illustrations and images reproduced on the site are reserved under copyright as well as intellectual property.
Any reproduction, even partial, of our models is strictly prohibited and exposes offenders to the penalties provided for by intellectual property law without prior authorization from WAAM COSMETICS.
8. Default of Payment
WAAM COSMETICS reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.
9. Terms of delivery and delivery times
For delivery in Metropolitan France: The products are delivered to the delivery address that the buyer indicates during the ordering process. The costs of participating in the preparation and shipping of the order are free for orders over € 45 including tax on the site www.waamcosmetics.com up to a maximum of 5 kg, beyond the delivery costs are applied. Delivery charges are also applied for any special order (item not listed in our web catalog).
Below 45 euros including tax, delivery costs are calculated on the site according to the weight of the order and added at the end of the order.
Delivery delay: Your orders are processed as quickly as possible by Customer Service and Shipping Service, open Monday to Friday inclusive.
Packages are sent upon receipt of payment, payment by credit card guarantees the speed of processing your order.
Terms of delivery: Shipments take place within 48 hours of receipt of payment for your order, unless otherwise indicated on the "cart" page.
After delivery by our Shipping Department, your order is delivered within 2 to 3 days by Coliposte (colissimo tracking), for Metropolitan France. These deadlines are understood to be working days, excluding postal delivery problems.
If you are at home when the postman passes by, he will deliver your package directly to you. If you are absent during his visit, he will leave you a calling card in your mailbox. You must then present yourself with your transit advice note and an identity document at the post office mentioned on the transit advice note.
In the event of physical or technical impossibility for the carrier to deliver the buyer, the former will return the package to the seller after a variable retention period. The costs of a second shipment will be borne by the buyer, following the following reasons:
- repeated absence causing it to be impossible to deliver for the carrier until the retention period.
- error in the registration of the delivery address due to the buyer.
In the event of non-complaint of a parcel at a relay point resulting in a return to the seller, the shipping costs will be deducted from the reimbursement of the buyer's order. If the buyer took advantage of free delivery during the validation of his order, the shipping costs will be billed to him.
Import instructions We cannot be informed of the legislation specific to each country. It is therefore up to each customer not to order goods prohibited for import into his country.
If this were however the case, we will not be held responsible for the rejection of the goods by the competent authorities.
From parcel to delivery: If the products need to be returned, they must be the subject of a return request to WAAM COSMETICS within 10 working days of the delivery date. To do this, contact WAAM COSMETICS by post or email: firstname.lastname@example.org
Any complaint made after this deadline cannot be accepted.
Returns can only be accepted for products returned in their original packaging.
In case of products damaged during transport, it is imperative to declare it to La Poste. The complaint must be filed with the postal services in order to obtain the replacement of damaged products.
It will be necessary to send photos of the package or of the damaged or incriminated products in support of your complaint.
WAAM COSMETICS cannot be held responsible for any delay in delivery in the event of force majeure, bad weather, flood, fire, strike by postal services, transport services, etc.
In the event of non-delivery of an order or part of an order, the buyer has a maximum of 2 months (from the date of departure of the package) to come forward. Beyond this period, no complaint will be accepted.
From the moment the package is delivered (2), it is considered as actually delivered to the customer. In the event of a dispute, the buyer is invited to contact his parcel distribution center as well as WAAM COSMETICS to set up a joint complaint procedure against the carrier.
(2) The packages delivered are subject to flashing which gives rise to the display of a "delivered" status on the site www.laposte.fr/colissimo. This status is displayed on the La Poste website when the buyer or recipient indicates the tracking number of the package. The tracking number is specified in the email sent to the buyer to inform him of the shipment of his order.
As soon as the absence of delivery is confirmed by the carrier, the buyer is entitled to a refund which is made either in the form of a credit note, a parcel redirection or refund in euros, at the latest within thirty days following the date of receipt of the reimbursement request.
WAAM COSMETICS, as the seller, is required to prove that the goods have been dispatched but cannot be held responsible for loss of packages.
The goods offered by WAAM COSMETICS suppliers comply with current French legislation.
The consumer is informed by these general conditions of sale that WAAM COSMETICS is a retailer and reseller and not the manufacturer of the products offered for sale on the site www.waamcosmetics.com. In the event of damage, only the responsibility of the supplier of WAAM COSMETICS and / or the manufacturer of said product may be sought by the Purchaser.
WAAM COSMETICS cannot be held liable in the event of non-compliance with the legislation of the country where the goods are delivered.
The photographs and texts reproduced on the site and illustrating the goods presented are not contractual. Consequently, the responsibility of the Company WAAM COSMETICS can not be engaged in the event of error or modification in one of these photographs or one of these texts.
WAAM COSMETICS, despite the efforts made in this direction, cannot guarantee the exhaustiveness of the information made available on this site, which depends exclusively on the information provided by its suppliers.
Deadlines, descriptions, photographs and prices are subject to change without notice.
11. Right of withdrawal
In accordance with article L.121-16 et seq. Of the Consumer Code, the buyer has 14 working days from the date of delivery of his order, to return any item that does not suit him and request the exchange or refund without penalty. If this period normally expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.
Any return of merchandise must be made in its original condition and packaging (merchandise can be returned in a new package), sealed and unopened with the original invoice, and is carried out at the buyer's risk. The refund will be made within 3 working weeks of the withdrawal.
